Can a property be transferred without physical presence
28-Jun-2023 (In Property Law)
Hi am a Muslim and married for 10 years. My husband owns a property and wants it to gift transfer the property to me. I am not in India . can this transfer take place without our physical presence in india
As per the Registration Act, the presence of the donee is mandatory for execution of a gift deed during registration of the deed. But if you cannot be present in India then you can execute a power of attorney in favour of someone trust worthy who can accept the gift, execute the deed and get the property mutated on your behalf.
