06-Dec-2023 (In Property Law)
Dear team, I am buying a property in Mumbai, the said flat ( under construction) was bought by an HUF from builder under allotment letter date 2001 which was not registered . Then the HUF and builder and new party A has entered into an tri party agreement where HUF sold the flat to part A in a sale deed 2005 which was registered. Now I am buying from party A, could you please let me know if the HUF (any co-parcerners or minor co-parcerners) can file a caes against me. if yes how can I resolve this

Firstly you need to undertake a complete due diligence of the title of the property. You need to check and appoint a lawyer for an entire advise as to chain of agreements and public notice to be issued showing your interest in the purchase of the property. For a safer side you can also get a title certificate issued by a lawyer.
