Buyer wants to get the token amount as he refused to buy the flat

Buyer refused to buy after paying token by cheque of 1lakh rupees and now want his money back no mou signed between us For my personal flat due to he can't get the loan from bank due to registration . Now he is willing to have his token amount back .

As there was no MoU signed for the same and verbal agreement in case of transfer of property do no hold value in the eyes of law. Also, the buyer can not claim the refund of the token amount. Also, if you had any clause related to the earnest/token money being forfeited in case of cancellation then you should not worry about the same.
