Builder not returning token amount even after cancelling booking

Booked an underconstruction property in Mumbai (Possession Dec 2020) giving token of 2 lakhs on 30th Nov'18. We were promised allotment letter with all details within a week of giving token, but still havent received. Also, we had informed not to clear the token cheque unless the Maharera application and allotment letter sample is shared. Yet the cheque got cleared without sharing details. Later came to know that the higher floors where we had booked were not even applied under Rera (from soft copy of tentative allotment letter shared by mail on 14th Dec'18. We informed to cancel booking and return token if so, on 16th Dec'18. But builder not ready to return token even after sending mail. They kept on convincing us to continue booking, which we never accepted. Instead sending us letter that we are defaulters in payment. Why would we pay further if we want to cancel booking? In Apr,the higher floors are rera approved but we dont wish to continue booking with such cheaters. Kindly help

First of all please read the terms and conditions clauses being mention in the allotment letter given to you by the builder. After that you can approach the police station and file a case against the builder for cheating and etc
