Builder not providing right to the roof top what action can i take?

I have a flat, the builder buyer agreement clearly states that they have complete right on the roof top. As a flat owner what the builder has done, is it right or wrong?
Right is deferent type as selling right, easement right, etc you have not clear it , I request you to sent me coplete paragraph in which right has been mentioned .
1. The buyers have proportionate share in the common portion of the building which includes roof.
2. However the builder can by agreement with the buyers of the flat restrict this right to himself.
3. So if in the agreement you have no roof right, you can't enforce the same now.
