Builder is not paying pre emi according to subvention plan what to do

I bought a flat under subvention plan where builder will pay the pre emi to bank till we get flat possession however builder is not paying the pre emi to bank neither we have got the flat possession
Subvention Scheme is a new form of bank financing for home loans. According to this scheme, after an individual applies for a loan for a property under construction, the concerned person need not pay any Pre- EMIs till fixed period or possession i.e., all the interest till fixed period or possession will be paid by the developer. So, basically you own a property without having to pay any interest till fixed period or possession.
However, in your case you can file the complaint under Consumer Protection Law and also under Civil Procedure Code if the act is in violation with any of the terms of the agreement
