Builder did not finish the project at time what rights do we have?

we gave our property to be demolished and build 4 apartments. The builder takes 25% (1 apt) and we have 75% (3 apt) ownership. The builder sold one apartment (unbuilt) but have not finished building the apartments at time. According to the contract he had 15 months +3 months grace period. But it is been more than 2 years now..close to 3 years. Builder is refusing to talk in the phone and avoiding us. He reasoned financial issues and is not showing any improvement in construction. We need legal advise on solving this issue

You have options to file civil suit as well as to lodge consumer complaint against the builder.
In civil suit, you may file a suit for permanent injunction against the builder to not to alienate the portion of property allotted to him, the other reliefs are for demanding compensation for the loss due to incomplete construction of the building, for delay in completion of construction and for mental agony and also to not alienate the property or to encumber any further.
The reliefs demanding compensation for the loss due to incomplete construction of the building, for delay in completion of construction and for mental agony can be sought through consumer forum too.
Firstly issue a legal notice to the builder demanding all the said reliefs and after his reply you may decide the next course of action on it.
