26-Oct-2024 (In Property Law)
My self pradeep book room at ulwe sec 25 under construction at may 22 . Builder say it will complete in one year, from cbi bank taking loan , on 9 th aug 24 it get oc that time he said after oc within one month I will give possession but still not response from his side
Under the Maharashtra Real Estate Regulatory Authority (MahaRERA) Act, a builder is required to hand over possession of a property by the agreed completion date. Since you booked a room in Ulwe, Sector 25, in May 2022, and the builder promised completion within a year, you have grounds to take action if there’s a delay in possession, especially as the Occupancy Certificate (OC) was received on August 9, 2024, and the builder assured possession within a month.
According to MahaRERA guidelines, if the builder delays handing over possession without valid reasons, you can file a complaint against them. The MahaRERA Act entitles you to seek compensation for the delay, including interest on your investment until possession is granted. You can also request a full refund if the delay is unreasonable or if you no longer wish to continue with the property.
To proceed, file a complaint on the MahaRERA website. MahaRERA provides an online platform where you can submit a complaint regarding the delay in possession. Document all written communications with the builder that mention timelines, possession dates, and any assurances made. You can claim interest for the period of delay or seek compensation for financial loss due to the builder’s failure to meet the possession date.
