Brothers invested some money to help me buy flat now want equal share

23-Apr-2023 (In Property Law)
20 y ago I bought a property in my name. But my two brothers are saying that they have an equal rights in that property as they have contributed some money in buying the property which is now registered in my name. I can pay them their contributed money but not want to give them an equal share in the property. Now they are residing in that property and are ready to fight with us for an equal share in that property. Please tell what to do

First of all certain information is necessary. Like since when these brothers are staying in your property and in what capacity they are staying in that property. Did you give them anything in writing for staying in your property. However, presuming that they are staying in that property without any written authority from you, they can be treated as illegal trespasser. You can launch criminal proceedings against them as illegal trespassers. This will be faster than the civil proceedings

Legally the property belongs to you and just you. Please don't say in writing or orally that your brothers have any share in the property. Written admission can be very well misused while oral admission can be recorded and then presented before court. Firstly you should file a suit for permanent injunction and an eviction suit so you can get them out of your house. And then the possibility of a settlement through a written agreement or through paying them the requisite and closing the case, can be explored before the court.
