Brother told to give share is saying will give later can i ask early
17-Feb-2023 (In Property Law)
Father had self acquired property for which he made a Will in 1997 and gave no share to me. But later things got better between us and when he was bed ridden he orally said to me and my elder brother to share the property to which my elder brother agreed. He gave me part of the bank balance of father and said will give once he sells the property after 1 year death anniversary of father i.e. April 2016. I have some debts to pay and need money urgently. What can i do in such situation?
We suggest that you first of all get the property mutated in your name and your brothers name. In case your brother does not agree then you can file a suit for partition and seek your share.
Regarding the WILL, the same can be challenged at any point on the ground of fraud , undue influence or that your father was not in the mental condition.
