Brother not vacating flat owned by father what can we do

Dear sir, We are Hindu, My daddy is 83 year old,& have his own purchased flat. we are 4brothers.We 3 of them are staying seprate with our family, and our elder brother is staying in the daddy owned flat with there family from last 15 years.he is not maintain any relation with any one. even not with the daddy.daddy is staying parly with all three of us. recently daddy decided to sell the flat and distribute the property to all 4 of us brothers. but shockingly my brother denied to vacate or support to sell the flat. even he and his family are not permitting even daddy to enter the flat.pls help
You can file a suit for partition of the property. An injunction can be obtained against the brother who is not vacating the property and a direction to co-operate in the partition of the property. Once you are armed with the Court order, you may enter the flat till the hearing and final disposal of the suit.
