Brother in Law passed away so can sister get a share in property

Hi my brother in law passed away on 17th Oct 2016, so now inlaws creating some problems.i have 4 questions. (1) Can my sister get share in ancestral property. (2) Father in law is dead but mother in law is alive and 2 elder brothers of my brother inlaw so is mother inlaw as rights to give the property to her 2 sons and not giving my sister her share. (3) Her inlaws not giving death certificate and ID proofs document of my sister to us, and 1month before the death of my brother in law elder brother tried to beat my sister so can we file a case of domestic violence againt elder brother now, and not giving document also so can we file a FIR of domestic violence and misplacing documents on the 2 elder brothers (4) what if the ancestral property is not divided by court just few people sit together and divided mutually by writting on plain white paper, not even of stamp paper so it valid or not

Wife of the deceased has all the right to claim her share over the property. It is well within her right to file a suit for partition or declaration and even restrain the living brother-in-law to dispossess them or alienate the said property. Contact for further opinion
