Breach of Contract in property by seller

27-Nov-2023 (In Property Law)
Bought a house at X amount, seller didn't sign the documents at the time of execution of sale deed. They said Deal amount is X' (>50k of X) & they already signed the Agreement to sell (ATS) of X deal amount. To avoid this conflict, i agreed to pay the X' into part payment ( one of 20k has been already released before the execution of sale deed) & 30k is still pending. Same has been mentioned on a Notary. Now, I'm unable to give the rest amount & seller is torturing me. In this case, what should I do?

You can’t do anything rather you might have to pay the double the amount mentioned in ATS ;if any ! You should you hired an advocate before doing any such deal ! First you have signed the papers yourself now at your own fault u r seeking legal loopholes! It’s better you talk to the seller in social way ! All the best

Hello Sir.

This is Adv. Shrikant Samantara.

You may file a suit for specific performance for the registration of Sale Deed or refund of your amount already being paid.

You may share the documents with me, So that i would be able to guide you better.

Regards.
