Bought property in mother's name is it considered as benami property

01-Feb-2023 (In Property Law)
I have bought property in mother's name as I do not reside in India. Does it come under any benami property act. I did not buy it in my mother's name to save any tax. Do you suggest I now transfer the property in may name.

Hi, Recently IT department started investigating on benami properties. Your mother may receive a notice asking for clarification of source of fund, even though you did not buy to save tax. Before you transfer the property to you name , you may get legal opinion from a property/tax lawyer.
