Booked flat with builder. Occupation certificate not obtained. Remedy?

One of my ex-colleague has invested in an upcoming project of Suraj Parmar's Cosmos group. He was due to get the possession of the flat in the month of Sept'15, but was been told that the possession would get further delayed to few more months as the occcupation certificate was still pending from the municipal officials.Now with the shocking demise of Mr.Suraj Parmar and the non clearance from the municipal officials, he is finding himself vulnerable to getting the possession. What legal way/ right/procedure he could avail of to get the possession confirmed?
Your ex-colleague can send a legal notice to company through lawyer, if he fails to provide you the possession, then you can file a consumer complaint in the state commision and seek compensation for delay of possession.
