if your father wants to oppose he should immediately send legal notice to his brother n then file civil case against him where you can ask for such illegal construction.
unless there is no such agreement where your father agrees to give up his share or has taken certain consideration you can approach civil court.

This is my response to you:
1. Is this a court matter?
2. If yes then what is the current status?
3. You will have to contest the matter on your own merits;
4. You will need to disclose more facts;
5. Consult a local lawyer and take steps.
