Agreement to sell with partition clause

Sir
I had done 2 agreement to sell with party in 2015 different dates and recieved half consideration.Agreement to sell clearly states that partition will be done in one month and then sale deed will be done after 6 month.Due to court stay partition could not be done in one month and Buyer filed case for specific relief.My questions are
1.Is agreement to sell is valid if Partition could not be done in one month
2.Can buyer seek specific relief for different dates agreement in one suit
partition after that sale deed will be made but because of stay partition so you have to see what buyer filed case for specific relief then your agreement to sell is valid partition could be done within 1 month
