About name transfer in share certificate

There are 4 beneficaries in mother's will. I and my brothers name are in mother's WILL. Iam the sole nominee of mothers residence.But my brother is contacting our society and saying wrong things. The society is not transferring the names of the beneficaries of mother's will neither transferring my name as nominee and beneficiary. They say they need brothers consent.How to change name in share certificate. How to transfer ownership.

In your case, the society is right to be cautious because a nominee is only a trustee and not the absolute owner, and where there is a Will with multiple beneficiaries, ownership has to be decided as per the Will. If your brother is objecting, the society will generally insist on either consent from all legal heirs/beneficiaries or a probate of the Will (mandatory in Mumbai) or a court order. You should therefore initiate probate proceedings to establish clear title, after which the society will be bound to transfer the share certificate as per the Will, and your brother’s objections will not hold legal weight.

hire a good advocate and he will tell you that you have to file civil suit gains society and your brother and claim should be declaration ownership as per mother's will in said area where ur mother make you sole nominee
