Fair Compensation for Father’s Death

12-Sep-2025 (In Motor Accident Law)
My father, died in a truck accident on April 2022. Case is pending in Assam. Gross salary ₹53,225/month, net ₹45,670. Age 49, wife + 3 children as dependents. Advocate offers ₹57 lakh settlement. Is this fair under MACT rules? Can we claim full compensation (~₹1 crore) including interest?

Based on your father’s age (49), salary (₹53,225/month), and 4 dependents, the normal compensation under Motor Vehicles Act rules is likely to be around ₹95–100 lakh including interest. The offer of ₹57 lakh is quite low and not fair as per the usual calculation method followed by the Motor Accidents Claims Tribunal (MACT). You can continue the case and claim the full compensation, along with interest from the date of filing.
