Rights of women in bail matters


  • If you are accused of a non-bailable offence which is punishable with death or life imprisonment and have also previously been convicted for 3-7 years for an offence, you shall be granted bail.
  • Under any kind of offence, you cannot be arrested after sun set and before sun rise and if any exception arises, only a woman police officer can make the arrest, after obtaining prior permission of the Judge within whose local jurisdiction the offence is committed or the arrest is to be made.
  • You cannot be kept in a police station even for a single night, except in unavoidable circumstances.
  • If a police officer makes an application to keep you in police custody, he shall be responsible for your safety and decent custody.
  • In case you are being searched for getting re-arrested, such search shall be made by another female with strict decency.
  • You must be treated with all due dignity, irrespective of the nature of the crime you have committed.
  • You should not be kept in the same prison, as the adult male prisoners.
  • You should not be handcuffed.
