A Caveat is a Latin term meaning 'let a person beware'. It is an application filed by a person in a civil court against one or more persons, pursuing to be heard in a court before passing any ex-parte order against him in any legal proceedings that may have been filed by the persons against him in that court. Under the law, the caveat exists for 90 days from the date of its filing. The notice of Caveat along with the copy of the caveat Application is required to be sent to each individual against whom the caveat has been filed. In case the opposite side files any case against the person in the civil court, the court cannot award any ex-parte order but in fact, issue an urgent notice to the person to appear before the court with a reply. However, in such situations, the person has to prepare and file the reply at a very short notice and also be prepared to argue against the same in the court.
A caveat petition is a precautionary measure undertaken by people when they are having a very strong anxiety or fear that some case might get filed in the court regarding their interest in any manner.
