Whether Tenants can form society & become members in Mumbai

26-Jun-2023 (In Landlord/Tenant Law)
Our building is almost 60 yrs old which was owned by Trust & it was later on purchased by our landlord in the year 1993 , it is of 3 floors ( Ground + 1 is Padgi system & 2nd & 3rd floor is ownership flats) We are remaining 4 tenants residing in the said premises. We are planning to form a society with other ownership flat owners. My question is whether Tenants can form society & become members? How many persons required to form society under this condition? What will be tenants rights once the society is formed?

This is my response to you:
1. You will require NOC from the landlord as well;
2. The society can be formed if the tenants have agreed to it;
3. You can form Flat owner Societies;
4. You will need certain documents: example: Model by-laws, Form A filled, Bank balance certificate, title clearance certificate from advocate etc.
