Tenant not vacating and not paying rent

My legal agreement expired and tenant not vacating the flat and neither has given 3 months rent and not paid utility bills .kindly suggest if I go legal how much time it will take . I am senior citizen and is going through lot of mental harrasment from my tenant.
First of all I need to know whether the property is commercial or residential as, for commercial properties the case is filed under commercial courts act and proceedings under this act are more speedy but if the property is residential then first of all you need to send a notice under sectjon 106 of TPA for termination of tenancy then after waiting for 15 days you can file a civil suit for arrears of rent, possession and mesne profits. In case your tenant admits his tenancy before the court then not much time will the matter take to be disposed of
