tenant not ready to vacate property nor paying rent

The tenant doesn’t pay rent of first of every month. Rent is overdue and in arrears by 2 months most of the time. After numerous reminder, the tenants pay the rent arrears end of the month or 2 months. I pay the tenants electricity bill and the tenants do not refund this money without numerous reminder. The tenant lives upstairs of a two-storied building and I live in the ground level. The tenant does not close the gate on numerous occasion and leaves it open at night causing safety concerns. It’s a residential building and the tenant has many visitors coming and going causing me and the neighbour nuisance. Lately the tenant doesn’t live in the building and comes by to pick up stuff and drop off stuff and visits the property every other 3 or 4 days and is living somewhere nearby. We have asked the tenant to vacate the property by end of March by giving 2 months’ notice but the tenant refuses to vacate the property. Please advise what are our options to evict this tenant.

If you do not have any rent agreement with the tenant then, as you have served the notice for eviction, you can file a suit for eviction in the jurisdictional civil court for the same. Also, if there are any dues to the same then you can also make an application in the eviction for the purpose of returning the amount or payment of the same.
