Tenant neither paying nor vacating

I gave my first floor apartment on 11 months lease.in Sept 2015.Initially tenant was regular in giving rent & lease was verbally extended on mutual terms. For last two years he has been irregular in payments & as of now more than 08 months rent plus other charges are due. He is seeking time on sympathetic grounds but neither paying nor vacating. We have now reached end of our patience & seek legal help to recover money & take possession of our apartment.

You must initiate legal action ASAP. A strongly worded Legal Notice must be sent across for starters. A stipulated time for vacation and payment of arrears must be mentioned in the same failing which Legal action must be taken. Further and better particulars are needed for an effective opinion.

You will have to send a legal notice to your tenant and ask him to pay the rent as well as the possession of your property. Please note that you might even get double the amount or even more for the illegal occupancy by the tenant. You can contact me for further assistance.

You can recover possession of your immovable property by filing a civil suit under section 5 of Specific Relief Act and a separate recovery suit for the rent due. Your tenant cannot claim title to the suit as you already have a previously signed rent agreement.
