How can landlord initiate sale of building under pagdi system in Mumbai?
Landlord can sell the building
The owner/landlord has the legal right to sell the building even if rooms are occupied by pagdi tenants.
HOWEVER, the sale will be subject to existing tenancy rights.
Tenant does NOT become owner
A pagdi tenant does not acquire ownership rights in the room.
Tenant only has right to possession and occupation, not title.
Buyer steps into shoes of landlord
After sale, the new purchaser becomes the landlord.
Tenant continues as tenant on same terms and conditions.
Rent, repairs, and rights transfer to the buyer.
