Police verification not done by landlords policed filed FIR

Dear Sir/Madam, We as a owner or tenant failed to submit police verification of my tenant and unfortunatly did not got any notice as well. Yesterday police claiming that FIR will be filled il under section 188 against me and i have to report back to thana. So anyways just want to know the legal hassles or Is this can be taken care by some fine system.Because FIR something which I consider as a trivcjy part.Any advice would be of great help.

Section 188 of the IPC deals with "disobedience to order duly promulgated by public servant". This provision is attracted when such disobedience is likely it produce harm. In your case, the order you have disobeyed is one that requires you to complete tenant verification. However, no harm is likely to be caused by your ommission to do so. Though the police may still book you under this provision as it is a 'cognizable offence'. Complete the police verification at the earliest. If you feel that the police may still file an FIR against you then you should engage an advocate to handle the case as criminal proceedings will be initiated as soon as an FIR is lodged.
