Owner wants to do construction while tenant reside
05-Nov-2024 (In Landlord/Tenant Law)
I am a tenant. There is leakage from our bathroom to house below. The landlord wants to break tiles and change pipeline while we live. Only 1 washroom in house. I told owner that he should give us 1 month notice. We do not want inconvenience. But owner threatens to give 10 days notice. I am in lock in period. What should I do?
Since you are in a lock-in period, you have a right to expect a stable living environment without undue disruption. However, issues like leakage often require urgent attention to prevent further damage, which may explain your landlord’s insistence.
One option is to discuss with your landlord the possibility of temporary accommodation support during the repair period or negotiate a rent adjustment for the inconvenience. You could also request that the repairs be scheduled for a specific time that causes the least disturbance to your routine.
If the landlord insists on the 10-day notice and you find it unreasonable given the lock-in period, review your rental agreement to check for clauses that protect your right to undisturbed occupancy or specific procedures for repairs. If negotiations fail, you may consult a tenant rights organization or lawyer, as some states have laws protecting tenants against unexpected eviction or harassment during repairs, especially when they have complied with the rental terms. Document all communications with your landlord to have a record if the situation escalates.
