How to transfer property in cousins name

Having shop of uncle. Uncle dead 1996.stil shop not transfer on any one name. We want to transfer shop on uncles son. But landlord asking 40%of property value.also he will file the case against us for having unauthorised person operating the shop. Pls suggest me how we can transfer the shop on. Cousin name

You can very well gift the property to your cousin by gift deed . It should be compulsory registered before Sub. Registrar and as far as stamp duty is concern you have to approach your local sub. registrar office and get the valuation of the said flat and thereafter get draft prepared from an Expert lawyer and if their is any other d consenting party and later on you have to also get medical certificate as a precautionary major to avoid further conflict and get it registered in the office.

Sir civil suit against uncle son. The agreement of father paid 40 percent paid amount. But your father died then your responsibility of property transfer of my name and remaining payment are paid it. Sir filed a civil suit for sale deed of legal heirs agreement holder sons

Dear Querist,
The Rent reciept ought to be transferred to the legal heir of your uncle ( if only one) else relinquishment of tenancy rights have to be done by the other legal heirs. You need to then apply to the landlord with relevant documents and if the landlord still doesn't transfer the rent receipt you need to file a declaratory suit for declaration of tenancy rights by the court of law
