Eviction process for licensee in west bengal for non-payment of Rent

Dear Sir, Being a landlord, I signed a Licensee agreement (Licensor-Licensee) for 11 months started on July 2016. But the Licensee is not paying, rent (in time), maintenance charge (never paid) and electricity bill (never paid). Even sending edited (forged) NEFT transfer document to proof the payment has been done. The property is in Kolkata, while I'm based in Bangalore. May I know for eviction process a) If I can handle the process from bangalore and . b) Please let me know the step by step process of eviction I need to follow (as I heard the process differs from state to state). c) So far I requested the Licensee to make all the payments, no discussion has been done on eviction, but I want to do it. d) The pending amount is more than the security advance taken from the licensee. How to get the additional amount from the licensee with the help of law? Thank you for your help always.

. You should have got the leave and license agreement drafted by a lawyer. If the leave and license agreement is not properly executed the protection of rent control laws is not available.

3. If the agreement was executed between your mother and the tenant then your mother alone should have signed the rent bills/receipts. It may be difficult for you to explain in the court that this man is your tenant. Be that as it may, the only legal remedy available to you is to file a suit for the eviction of your tenant in the court.

4. Show the agreement to a lawyer and see if anything can be worked in your favour.
