Article 19 of Constitution lays down Fundamental right to practice any profession, or to carry on any occupation, trade or business.b. Section 27 of the Indian Contract Act, 1872 states that any agreement made in restraint of trade and profession is considered void. Breach - In case you breach your employment bond, your Company may file a suit in the court demanding for payment of the amount stipulated in the contract. The court will then see if the terms and conditions of the Employment Bond are appropriate and reasonable. If they are, then the court may order for paying an amount equivalent to reasonable expenses incurred by the Company on training and skill development of the employee. In case the Employment Bond is unreasonable, then a court may order the bond to be void. Note: the Company can protect its interest with respect to protection of trade secrets and confidential information.
