Not Accept the Resignation by Employer

Dear Sir/Madam, I had submitted my formal Resignation letter to my reporting boss & copy mark to HR & Director but my boss hasn't accepted the resignation due to non availability of employee instead of mine. He told me that they will release me while they will get new one. I can't continue this service for this uncertain time period. I also mail to HR. She isn't replying any. I am ready to serve the notice period also. What legal action should I take.? Please suggest.

Namaste. If I could understand your situation correctly, there is a stalemate in your situation where your manager has not replied to your resignation. In this case you are advised to give a legal notice asking them to take immediate action regarding the notice
