Is gratuity payable after 4 years + 190 days in a 5-day work week

02-Aug-2026 (In Labour & Service Law)
Permanent employee in a company with a 5-day work week. I've read conflicting opinions on gratuity eligibility. Some say 4 years + 190 days is sufficient, while others say 5 full calendar years are mandatory. Which is legally correct? Does the answer differ by state (e.g. Karnataka)? Also, do weekends, public holidays and paid leave count towards the 190 days, or only days actually worked? Please cite the relevant law/judgments if possible.
