Fraud in Form 16 of income tax

Hello, Company paid me a salary of just 17000Rs but while generating form 16 they have mentioned 55000 credited on my PAN no. Now while filing ITR I was liable to pay income tax for the salary which i have not received. does this fraud comes under cognizable or non-cognizable? if i do complaint to police, will police register my FIR for further investigation?

This is my response to you:
1. You should have pointed it out at the earliest stage;
2. You must immediately send them a legal notice;
3. State to them such kind of acts amount to fraud and is a cognizable offence punishable under IPC and IT Act;
4. If they do not correct the same, file an FIR against them;
5. There is a good possibility that they may have done the fraud to others as well;
6. Consult a local lawyer preferably a criminal lawyer and take legal action.
