Do i have to serve notice period during probation
22-Jul-2023 (In Labour & Service Law)
I have joined PSB as Direct recruit specialist officer at scale 2 on 01.06.2016. As per my appointment letter notice period after confirmation is 3 months but nothing is mentioned about the same during probation. I wish to resign and want to know about the notice period, HR says it is 3 months. Can I challenge this??
If you are not a confirmed employee as of yet, the notice period clause as encapsulated in the appointment letter is not operative and hence the same will not be applicable to you. In the circumstance, it is not necessary for you comply with the said clause while tendering a resignation and you may resign without observing the 3 months notice period by give a resignation letter simply. Challenging the notice period clause is not necessary.
Probationer does not need to go through notice period as he is not a confirmed employee. You can give resignation letter and leave outrightly if you are a probationer.
