Delay in Full and Final Payment
26-Jan-2023 (In Labour & Service Law)
Its been 82 days since my last day at my pervious company and approx. 56 days since the next payroll cycle after my release. I have been following up constantly with the HR on email and was given the 1st of January 2021 as the date they would release the FNF.
I have been following up since then but didn't receive any response until the 21st of January 2021. They mentioned " Unfortunately, the external team who handles the clearance is short-staffed and middle of an audit which is causing a delay"
Can this be a valid issue?
Its been 5 days since their mail and I have been asking for a confirmed date of FNF's release, or the length of the delay, but no response.
What should I do in such a case?
To answer your 1st query: the reason given by the company is not valid. In this case you can send a legal notice drafted and under signed by a legal professional like myself to the company for your full and final, even if after that you do not get a response within 7 days, you can pursue a full fledged civil suit against the company.
