Company has been delaying joining from 2 weeks

04-May-2023 (In Labour & Service Law)
A company hired me for their client which is one of the big four. I left my job, came to Mumbai from Delhi on their consent. Its been two weeks and they have not yet confirmed the joining date. They just keep delaying it. I have been writing emails and they rarely respond to that. Its a registered IT recruitment company in Hyderabad. I have lost money in terms of stay, the salary and the job etc. Can I file a legal case on this basis?

It depends on whether you had received the Offer Letter / Appointment Letter or not. You can claim compensation for the losses or damage incurred due to the said offer. You shall have to file a suit for damages and compensation against the company and you can take action on the following grounds: 1) Loss of employment as you had already resigned from your earlier job and obtained an NOC as well, with respect to the job. 2) If any agreement was signed then breach of contract. In case of no contract, you can also bring the ground of promissory estoppel. 3). Loss of livelihood. 4). Violation of principles of natural justice as you were not given a chance to be heard before cancelling your job offer.
