Clarification on section 409 of IPC

Sir, I am a village panchayat officer and i was suspended by my senior DPRO(DISTRICT PANCHAYAT RAJ OFFICER), and I took stay on that suspension order from high court, but senior authority neglected high court order and lodge a FIR against me under section 409,how can I get releief with the help of law, please reply
