Can I abscond without serving notice period

15-Apr-2023 (In Labour & Service Law)

I am working in a mnc for 10+ months. I got a better offer and want to terminate my service from present employer where notice period is of 3months. I tried to negotiate to settle and reduce the notice period to 1 month. They refused it and forcing me to serve for 3 months, I already served 1 month and still trying to get release within next 2 week because I have to join there after 2 weeks. I am ready to pay notice and bond money but my present employer is not liationing me. Can I just put a Mail for termination now and go away? My new employer doesn't need any documents from my present one.

As per your query, it is advisable that you do not leave the company without proper permission and serving the full notice period. If you leave without proper resignation, the company might file a case against you and ask you to pay compensation. Since your employment is governed by your employment contract, you will have to serve the notice period specified. If you do not fulfil the terms and conditions of the agreement the company can take legal action against you.
