17-Jul-2023 (In Labour & Service Law)
Can employer force me to serve full notice period? In appointment letter it's mentioned that " employment can be terminated by either employer or employee by way of serving 3 months prior written notice or basic salary in lieu of such notice to the other party"

Hi, No one can force an individual. If the termination clause is clearly mentioned that " employment can be terminated by either employer or employee by way of serving 3 months prior written notice or basic salary in lieu of such notice to the other party". You can exercise to pay back towards shortfall of notice. To get relieved in a healthy relationship, suggest to serve notice as requested. If not interested you can mention the clause to HR and insist them to oblige. If not agreed, send a legal notice through an advocate.
