As per service jurisprudence, resignation must be submitted to the competent authority as per the rules governing the Central Autonomous Body. Unless specifically permitted by law or delegation rules, such authority cannot delegate resignation acceptance to a State Govt. authority. If such delegation is without legal sanction, resignation acceptance can be challenged and may be quashed by a court. The facts of each case, including service rules, are crucial to determine legality.
