Dear Client, 1. You can file a police complaint for domestic violence, assault, and wrongful confinement against the persons abusing her. Also file a petition before the Magistrate under Domestic Violence Act seeking protection, residence, and custody of your wife and children. 2. Approach the family court for custody if children are at risk. Police and courts can provide immediate protection. 3. Consult an advocate to discuss your case in brief. 4. You may schedule an appointment regarding your case by phone or email at your convenience. Thanks & regards, Priyanka Advocate Coimbatore

You should immediately file a complaint with the local police under provisions of the Bharatiya Nyaya Sanhita (BNS) for wrongful confinement, criminal intimidation, and assault, naming the persons who have beaten and threatened your wife. Simultaneously, you may move an application before the Magistrate under the Bharatiya Nagarik Suraksha Sanhita (BNSS) seeking protection orders for your wife and children. You can also file a petition before the Family Court under the Guardians and Wards Act seeking custody of the children and residence orders to ensure they are not forced back into an abusive environment. Even if your wife is hesitant to admit abuse due to threats, medical records of her treatment and your complaint will be strong evidence. Approach the District Legal Services Authority for urgent protection measures, and if required, file a writ petition before the High Court seeking police protection and immediate rescue from the abusive household. This course of action will ensure her safety without pressing for divorce, which you do not intend to pursue.
