Dear Client, 1. You can file for divorce under the ground of adultery and desertion Hindu Marriage Act. Her false allegations of cruelty can be defended in court. Since she is refusing to return and live with another man, you can also seek child custody (Guardians and Wards Act). 2. File a divorce petition in family court with evidence (police complaint, statements, proof of her living with another man). The court will decide custody and maintenance based on the welfare of children. 3. Consult an advocate to discuss your case in brief. 4. You may schedule an appointment regarding your case by phone or email at your convenience. Thanks & regards, Priyanka Advocate Coimbatore
