Wife left matrimonial home on what grounds can i apply for divorce

07-Nov-2023 (In Divorce Law)
After 5 months of marriage wife left matrimonial home in March'14 without informing to me. All of my efforts to rejoin back again have gone into vain. She also aborted 2 months pregnancy without my consent but I don't have paper evidence for termination of pregency. Now I intend to file divorce petition. Advocate suggested me to first issue legal notice for seeking divorce on desertion & cruelty ground

On the above mentioned grounds subject to proving of the same in the family court , you can get the divorce ; basically it is not necessary to send her an legal notice firstly for seeking divorce and than only you can file for the divorce case ; though sending legal notice will favor you . Instead of that you should have earlier filed the section 9 case - but no issues you can still go for the section 13 case .
