Based on your facts, the wife’s petition will be assessed on whether she can legally prove cruelty as defined under matrimonial law. A single incident of physical altercation, when followed by immediate remorse, apology and continued financial support, is usually not considered sufficient to establish “cruelty” unless accompanied by sustained grave behaviour. Allegations of a past love affair, without evidence, also carry little weight. If you genuinely seek reconciliation, you may file a detailed counter-statement denying the allegations and highlighting the attempts taken to maintain the marriage, your apologies, financial support and willingness for mediation. Courts generally encourage settlement in such cases and can refer both parties to counselling/mediation under Section 9 of the Family Courts Act. At the same time, be prepared that the wife may oppose reunion. If she is unwilling, the court will evaluate the matter purely on legal merits. Ensure all communication records, apology messages, financial transfers and any supportive evidence are properly preserved to demonstrate your bona fides. It is advisable to engage a family-law advocate who can represent you effectively and guide you through the mediation and trial process.
