What action can i take if my wife has been living separately for 1yr.

my wife is living with her parents with her child from one year till date has not initiated any action . what should I do as a precautionary measure
You can move an application under section 9 of HMA 1955 ; for restitution of conjual rights . The other option is that you can go for the section 13 case - divorce ; if you wish to go for it . It basically depends upon you that what remedy you are looking for . If you do not want to entertain both the options than as a precautionary measure you can simply send her an notice regarding the same with registered post.

if u want to live with you wife file section 9 application under HMA, 1955 and also file complaint against your in laws before Rajasthan state women commission requesting the commission for mediation between you and your wife. Move application for custody of your child along with section 9 application.
