Dear Client, 1. You can file for divorce and seek child custody and child maintenance under the Hindu Marriage Act, 1955 or relevant personal law. The court will decide custody based on the child’s welfare, and the non-custodial parent may be directed to provide financial support (settlement/maintenance) for the child’s upbringing. 2. hi, I can well understand your concern from the query raised, the custody of the children will be determined by the Hon'ble family court, depending on the welfare of the child, and if the parents come to a mutual consent, the custody and visitation will be determined accordingly, thank you
