if you are Hindu, you can not marry without giving divorce to your first wife, if your first wife is giving you written consent than you can marry. but as per hindu marriage act, without giving divorce to first wife, one should not marry.

For the answer to be proper i need to know what religion do you belong except muslims all other religions practice monogamy and it is enforced by the law if you are a muslim then you can marry second time without any other process but other wise for your second marriage to be legal you need to take lawful divorce from your first wife
