want a legal advice against domestic voilance

If we are facing domestic violence and we want a divorce and it has been 20 years since we have been enduring all this, we need your advice about this. But our financial condition is not so good, so is there any law which helps women, to help them we get some financial help because I am a housewife and I have two daughters.

If you are facing domestic violence you can file a 498A police complaint against your husband, in which you can ask for police protection also. I would suggest filing a maintenance petition to get your maintenance for your expenses and your daughter’s expenses. Divorce can be obtained later when you’re at a position of power.

Hello, In this case, you can file for divorce on the ground of cruelty. Alongside, you may also initiate proceedings under the Domestic Violence Act, where you will be entitled to seek protection, residence rights, and compensation. For financial support, a separate petition for maintenance can be filed, through which you may receive monthly maintenance from your husband. Additionally, you can lodge an FIR against your husband under Section 498A of the IPC (now Section 85 of the Bharatiya Nyaya Sanhita), which deals with cruelty by the husband or his relatives.

Madam, you can file a case under the Domestic Violence Act for protection, residence and monthly expenses. You can also claim maintenance for yourself and your daughters under Section 125 CrPC and during divorce under Hindu Marriage Act. For divorce, a ground of cruelty is available.
