From the facts, the marriage with the wife is still legally valid in India, hence having a child outside marriage may attract charges of adultery or bigamy if he remarries without divorce. Bringing the foreign partner and child to India is not per se an offence, but the wife can take legal action including divorce on grounds of adultery, custody claims, and maintenance. The proper course is to file for divorce first, settle custody and financial obligations of existing children, and then legally remarry if desired. Until then, living with the foreign partner openly in India may create serious matrimonial and criminal complications. It is advisable to initiate legal separation/divorce proceedings before proceeding further.

Dear Client, 1. Yes, it is legally an offence under Indian law — specifically (adultery) (though decriminalized, it still has civil consequences) and also of the Hindu Marriage Act — as he had a child with another woman while still married. 2. He cannot legally bring the foreign woman and baby to India as his family unless he divorces his wife first. 3. He must file for divorce on grounds of separation, cruelty, or desertion, then may legally remarry and take responsibility for the other woman and child. 4. Consult an advocate to discuss your case in brief. 5. You may schedule an appointment regarding your case by phone or email at your convenience. Thanks & regards, Priyanka Advocate Coimbatore
